PSM sues local council for bringing down banner

It is perhaps the first time a political party is suing the Local council for not allowing its banner to be put up during the festival season. PSM Sungai Siput Branch did not want to take the attitude of the local council lightly and have decided to sue the local council Last week, they filed a suit in the Taiping High Court.

On 10th October 2007 the Sg Siput Branch of the Party Sosialis Malaysia(PSM) applied for a permit to put up a banner for Hari Raya. The local authority, the Majlis Perbandaran Kuala Kangsar (MPKK) initially granted the permit but took down the banner the following day because the banner had the words “Bersatulah Menentang Penswastaan Hospital dan Air” (Together let’s oppose the privatization of hospital and water) just below the Hari Raya greetings. As the MPKK agreed to allow the banner to be put up if the words “Bersatulah Menentang Penswastaan Hospital dan Air” were blacked out, the PSM decided to comply and the altered banner was put up.

However after that, the PSM sent an official letter to the SG Siput U OCPD as well as the MPKK pointing out that the MPKK’s decision impinged on our Constitutional Rights to Freedom of Expression as guaranteed under Article 10 of the Federal Constitution. We expected that the 2 agencies would refer to their legal advisors and correct their malpractice.

However when on 6th November 2007 the Party Sosialis Malaysia applied for a permit to put up a banner for Deepavali, the MPKK again turned this down because of the words – “Bersatulah Membantah Penswastaan Hospital dan Air” in the banner. PSM leaders attempted to explain to the Secretary of the Local Council but the latter was impervious. “Put up your banner in Ipoh then,” was his rejoinder when PSM members told him that the Local Council – Majlis Pebandaran Ipoh had given permission to put up similar banners in Ipoh.

The PSM then decided to file a case against the MPKK for violation of our Constitutional Right on freedom of expression. Ms Renuka Balasubramaniam from KL agreed to act as PSM’s council and the case was officially filed in the Taiping High Court on 17 th December 2007.

Sdr Letchumanan, the treasurer of PSM Sg Siput told the press that the MPKK was exceeding its powers. “Privatisation of Health Care and Water is ongoing in Malaysia. It is an issue that affects the people. Ours is a fair comment,” said Letchu. “The MPKK has no power to refuse us permission unless the banner has obscene words or is seditious in nature. Since the MPKK did not respond positively to our comments and our request for a dialogue in October 2007, we have decided to bring the matter to the High Court to seek a declaration that the PSM has the right to put up such banners.”

The date of mention has yet to be fixed.

Another show of defiance and the doorsteps of SUHAKAM

In yet another show of defiance, more than 400 people staged another protest at Kuala Lumpur. This time the public assemble was done at the door steps of SUHAKAM – the Malaysian Human Rights Commission. Today’s assemble in spite of recent intimidation, in spite of being a working day and in spite being the eve of a major religious function, still managed to secure an impressive crowd to protect the right to public assemblies.

The protest coordinated by a coalition calling itself “Coalition to Protect the Right to Assemble” was led by PSM’s Secretary General S.Arutchelvan. 50 Organisation endorsed the memorandum calling for the Aritcle 10 of the Constitution be respected, oppose the use of Magistrate Court Orders to curb the right to assemble and to support SUHAKAM’s stand in calling for Section 27 of the Police Act to be repealed. Section 27 of the Police Act requires organizations to apply for a police permit if they want to hold a public assemble.

This morning, the police put up a heavy presence along the SUHAKAM building. There were uniformed and mufti policemen all round the building leading to the Human Rights Commission. Two police chiefs – ACP Kumaran, Head of Public Order from the KL Police Headquarters and ACP Mohd Zulkarnain bin Abdul Rahman, the District Chief of Dang Wangi were present. Initially they asked the organizers not to have any speeches but PSM’s Central Committee member V.Selvam made it clear that, “Today we are here to exercise our right to assemble and we are not going to compromise anything. We will disperse ourselves in one hour’s time and if the police are not happy, then they can do what they like, we are not going to budge”. After a short while, speeches and slogans thundered the area. Among prominent speakers were Mat Sabu from PAS, Sivarasa from keadilan, Dr. Nasir from PSM and Malek Hussain from Manfrel, M.Sugumaran from JERIT and Amer Hamzah’ from the Bar Council. Comrade Sivan and Cikgu Badrul kept the momentum high with speeches and slogans.

Simon Oii representing the Students movement warned the Prime Minister not to challenge the will of the people. He said that the public assemblies will continue. Later, children of Berembang with FNB performed an act in front of the Human Rights Commissioners.

Three Commissioners led by Dr. Denison , Tan Sri Asiah Abdul Samah and Dato Siva Subramaniam received the memorandum. Comrade S.Arutchelvan handed the memorandum on behalf of the Coalition and announced that fifty one organization which endorsed the memorandum including all major opposition political parties, Human Rights Organisation – SUARAM, Amnesty International and HAKAM as well as community based Organisation led by JERIT, Women Organisation and Student groups.

In recent weeks, the ruling party has gone an a major offensive against Public Assemblies including getting court orders, arresting and charging people, media propaganda and other intimidation tactics. It was aimed at creating a zero assemble target. State run public polls as well as letters from the public and NGOs were published on how they oppose Public Assemblies and how Public Assemblies is bad for investment. The Prime Minister said that the economy has dropped 10% around KL because of street demonstration.

Socialism 2007 Malaysia – 50 years after Merdeka – Socialism vibrant and strives on

It was a day rumored that racial riots is going to hit the country especially Kuala Lumpur. People were told to stay at home while in other parts of the country, there were massive flooding. With this in the background, it was surprising that Socialism 2007 has lived up to the occasion with a huge turnout with all three sessions held in packed lecture rooms.

More than 120 people attended the 3rd. Socialist Forum organized by Party Socialist Malaysia (PSM). The theme this year was 50 years of Independence : The Left – Then & Now. The forum explored the role and contributions of the left in three critical phases – the era before independence, the Socialist Front period (1960s-1970s) and the period after the cold war (post 1989). As one participant said, “this seems to be the Annual Congress of the left in Malaysia and is very heartening to see so many young people among the veterans”. Indeed this year Socialism, had people from various age groups, ethnicity and background. It portrayed socialism as vibrant and kicking.

The program started at 9.30am in New Era College, Kajang with the Internationale song. Comrade Saraswathy, the deputy chairperson of PSM gave the opening remarks. She pointed out that history has been distorted and manipulated by the ruling government, which completely denied the role of the left in fighting for the Independence for Malaya. The fact that the left parties were branded as bandits especially Malayan Communist Party (MCP) by ruling party historians is very appalling. 

With that note, the first panel discussion on The MCP, Armed Tactics and Role In Independence began.  Comrade Letchimi moderated the session with 2 speakers from Singapore – Comrade Chen Jian (independent researcher of the Malaysian left) and Comrade Tan Jin Qui (member of UM Socialist Club & Singapore Socialist Front in 60’s). Contribution from both comrades raised two pertinent question – is the arm struggle justified? Did the people support the armed tactics?

The general view is YES. Massive suppression and exploitation of the British government against the people of Malaya to recover back their lost during World War II has led the MCP to decide during a meeting in Johor (April 1948), that they should dig up their arms. In fact, in December 1947, MCP already drew a policy of it’s role in Malayan revolution against British. In May 1948, they decided to lead the workers movement as well as to go all out to mobilize the struggle of the peasants. Tension was building up and in Jun 1948, British declared emergency. It came 3 months earlier than anticipated by MCP. MCP was ill prepared for the offensive. At one point MCP decided to use aggressive tactics to damage British economy but it affected the people badly. Immediately, an order was issued to stop all aggressive tactics. Nevertheless, the British spent billions on arms, soldiers and segregation plan to suppress only 7,000 MCP members. It was only after the mass workers movement was defeated and the open political parties were suppressed, that the MCP had no choice but to take an armed approach. The support from people for the People’s Constitution and the October 1947 Hartal (nation wide strike) are established proof of left influence and open front tactics.

After ½ hour tea break, we had another round of interesting speakers who spoke on Socialist Front era- Ideology, Electoral Politics, National Question And Repression with so much clarity. The speakers were C.C. Yong of People’s Party (Parti Rakyat), Comrade S.N. Rajah of Labour Party (Parti Buruh) and Comrade Chong Tong Sin who is currently a Progressive Book Publisher. They are the living proof of the current government’s repression during the Socialist Front Era. All of them spent between 8 to 12 years under the ISA(Internal Security Act) -detention without trial. Comrade Rani moderated the session.

According to Comrade SN. Rajah, after the MCP cadres and other leftist were forced to take arms, there was a vacuum in the political arena. Labor Party (LP) and People’s Party (PP) filled the vacuum to fight for the interest of the working class and they gained massive support from the people. The rightist on the other hand was harping on religious and racial sentiment. 

On Independence day 31 August 1957, PP and LP united under Socialist Front (SF). One Socialist Youth League was deregistered even before it could join SF. In 1959 election, both parties captured many seats in urban constituencies and new villages especially in the municipal elections. Ruling party was losing ground and they applied what their master, the colonist British taught them – repression & massive clamp down against the opposition. Thousands of leftist cadres (including Members of parliament) were arrested as well as other opposition party members. There was almost no qualified candidate left to stand for election, said CC Yong when there was a question from the floor as to why SF boycotted the 1969 election. He added, “to show our protest against the ill treatment of the government, the election was boycotted- it was a temporary decision and before we could review it, the party was suspended and SF was dissolved way back in 1966”.

The party was forced to boycott the 1969 elections as all its active branches were closed. This was the condition then and those who don’t understand the circumstances; keep questioning why the party did not stand in elections.  If….If we are allowed to dream…..if the clamp down did not take place…we are the government today, said Comrade C.C. Yong. Laughter and applause filled the room!

The discussion continued to National Question when a participant queried about the split between LP and PP over the issue. What comrade CC Yong shared really enlightened most of us. He said there was no major split over the issue especially on language because everyone felt there is need for one common language to communicate with each other. The party leadership was all out to ensure all cadres attend Bahasa Malaysia class organized by the party. During winding up, comrade SN Rajah said, “Many think the collapse of Soviet Union is the end of leftist, they are wrong, as long as classes exist, socialism will grow”. Comrade C.C.Yong reminded us, “Socialism is new, it has to face many challenges and the fruit of the socialist struggle will be seen by our future generation”.

After the lively discussion, we had another round of panel discussion on “What Is Left In Malaysia Since The Collapse Of The Berlin Wall-1989”. Comrade Kohila moderated the session and the speakers were Comrade Hassan Karim, President of Parti Rakyat Malaysia, Premesh Chandran, CEO of MalaysiaKini and Dr. Nasir Hashim, chairperson of PSM.

The issues, which seem to dominate is the definition of the word “left” itself.  Who is the left?. One person from the floor said, “ The capitalist always know, who are the left but it is the left who is always confused on who is the left among them”. There was also criticism against Socialism because it is seen as only relevant as long as there are poor people and it does not have the substance to move forward. It was said that in Malaysia, socialism has failed to infiltrate into trade unions, schools/colleges, and media because of restrictive condition and thus it is difficult to grow!

Darshan Singh was angry because he said, it is so simple. Those who support capitalism is right and those who support socialism is left. Let’s have clarity and move on. After heated argument and comments, it was established that things are not as rosy as people make it look like. Malaysia has the 2nd. highest income disparity in Asia and most working class families live in poverty. Dr. Nasir also said that professionals are also workers and socialist is not just a project for the marginalized but for the majority of the workers.

For the final session, it was What is to be done ? and the session was moderated by Comrade Arutchelvan, the Secretary General of PSM. Arul gave 10 scenarios in the global world from developments since the collapse of Eastern Europe, the growth of neo-liberal capitalism and its impact on the 3rd. World countries, the uprising and revolt in neighboring countries like Nepal, Pakistan, Myanmar and in Malaysia itself, the defeat of Welfare States in Europe, the failure of trade unions and the emergence of progressive movements in Latin American countries led by Venezuela’s Hugo Chavez call for Socailism in the 21st. century.

At the final plenary, many ideas were shared and among the ideas were that the party comes with materials on the alternative Malaysian history, have more full timers, training school, more channels to disseminate information and strategize on how to handle the racial tensions. PRM leader Hassan Karim also acknowledged PSM’s strength and said that his party PRM and PSM should forge a United Front to  built the left in Malaysia.

Socialism 2007 ended with the Internationale. Many people agreed to subscribe to the party’s newspaper and a number of them became members. We will carry the touch, the flag and the banner. We will march on until capitalism and Imperialism is defeated in Malaysia and the world. Long Live Socialism ! Long Live the Struggle !

Berembang eviction declared illegal

At 10.45 am, Justice Datuk Mariana gave a judgment at chambers in giving the Kampung Berembang villagers a 3-0 victory over the developer. The news of the victory was announced by Edward Saw to the villagers outside the court which brought applauses, joy and a victory long overdue.

The Judgment dismissed the developers the right to vacant possession as the court felt there were tribal issues to be heard and they were told to pay cost. The Court further ruled that the ex-parte injunction was executed wrongly where the developer demolished and forcefully evicted the villagers. This act was seen as illegal and the court told the developer to pay damages as well as cost. The amount will have to assessed and paid. The villagers were represented by Edward Saw, K.Shanmuga and Amer Hamzah.PSM Chairperson Dr. Nasir Hashim, Secretary General S.Arutchelvan as well as JERIT Urban Settlers Coalition Head  E.Paremas were  present on this historical event. Comrade Arutchelvan said that the victory was only made possible because of the strong and consistent resistant put up by the Berembang settlers. They stood up and rebuilt their homes even after 5 forced demolition. It was a victory due to them but the struggle is far from over.

This judgment today was a blow to the developer Permodalan Nasional Selangor Bhd (PNSB) and Perspektif Masa Sdn Bhd. It was also a slap on the face of the Menteri Besar Selangor, Khir Toyo and Exco Mokhtar Dahalan  who said that the villagers will lose the case if the brought to the courts. We wonder who the Chief Minister will give the “Broom” now for not resolving the Berembang issue.

BEREMBANG – IT IS NOT OVER YET!

Ampang, 7 March 2007

There were only three houses to be demolished and a number of tents but yet it took hundreds of policemen and women including the FRU, the Developer’s people and their thugs to demolish the houses and bring down the fierce resistance put out by the Berembang settlers and the activist who stood with them.

What would in normal circumstances take only half an hour to complete took an entire day and till the last plank was removed, the resistance never surrendered. At the end of the day, the Developer and the police went into an agreement allowing the settlers to camp just outside the current village area and the developer forked out RM 60,000 to pay some compensation. It was astonishing to see the developer who previously refuse to fork out even a cent succumb so fast. A black and white agreement was signed with the developer, the police and the people’s representative putting their names on it and the agreement was scrutinized by the settlers representative which would not stop them from taking further action.

The lawyers who were at the scene – Latheefa Koya and later joined by Edmond Bon and Teng Chang Khim all declared that the demolition today was unlawful and the police’s action illegal. The police led by ACP Amer Awan though kept maintaining that he was only ensuring the peace took a clear side in assisted the Developer – Perspektive Masa Sdn. Bhd. to carry out this illegal operation. The lawyers seeing the brutality in their own eyes have vowed   to take legal action against the developer and those who assisted them at the demolition.
The current legal tussle started when on Monday, the Kampung Berembang Chairperson was served with a letter from Tabian Tahir & Co stating that the Developer of Kampung Berembang –PNSB has obtained an Interim Injunction to prevent the local people from stopping the developer’s work.

The same letter states that if the people do not follow the order then the Developer can go for committal proceeding to execute the order. This is normally done after two weeks the first notice is submitted but on that same day, the developer with the full protection of RELA and gangsters from Klang started demolition work. The interim Injunction was not served on the people and legal experts have called this a miscarriage of justice.
With no regards to due process, the developer armed with RELA and gangsters and the police force went on the rampage. To make matters worst, an inter parte hearing was fixed for the 14 th. Of March 2007 which is just next week. The people managed to stop the demolition the other day. This morning, they came back again and it was said that the Selangor Chief Minister himself Khir Toyo instructed the homes be demolished and the Selangor Police Chief carried out the orders to assist the developer.
     
The people resistance led by 60 remaining settlers has been backed strongly by JERIT and its coalition members – Urban Poor Coalition and the Youth and Student wing Coalition along with Parti Sosialis Malaysia(PSM) led the fierce fight-back. Today’s resistance also saw the united front of the opposition parties joining in from PAS, PKR and DAP leaders. Tian Chua was arrested while other leaders such as Dr. Nasir Hashim, S.Arutchelvan, Hatta Ramli and Sallahuddin were all physically removed from the houses. Later, it was made known that Tian was arrested for “attempting murder” when all he did was break an illegal barricade created by the developer and their thugs to stop outsiders from coming into the village. All in, six people were arrested for various ridiculous reasons but the police though arrested dozen’s of people at every encounter, released them immediately.

This morning, the developers attempted to seal the front entrance and brought in their lorries and machinery to do earth work and remove the peoples belonging as well as demolish the remaining houses. They were met by strong resistance and many fights occurred at numerous occasion. Both sides sustained injuries during these encounters. Two policewomen were removed from the scene – one of them hurting her leg while the other women just broke down and could not handle the pressure.

The settlers and the activist then stay put inside the houses while hundreds of policemen and developers would try to demolish these homes. It would take the police and the developers more than an hour to bring down these houses in spite of their huge numbers. It would normally just take 3 minutes to bring down a settlers house on normal circumstances.

Background

Kampung Berembang is located at Jalan Ampang near Hospital Gleneagles. There were at one time more than a hundred families living here and they have been building this settlement forty years ago. In 2003, the people were promised low-cost houses by Pemodalan Negeri Selangor Berhad, Acmar International and Perspektif Masa Sdn Bhd. These homes were to be built near the current village but these houses are yet to be built.

Under these circumstances, the settlers were given eviction notice on 17/11/2005 to vacate the village. They were not given alternative permanent homes but were offered temporary homes at Puchong – 30km away. The settlers refused and asked for relocation near-by as it is the State Government policy to relocate within 2-3km. The State used the draconian Emergency Clearance of Squatter regulation 1969 and gave the villagers seven days to get out. A group of brave settlers then decided to fight this order and they were assisted by Sdr. Teng Chang Khim – the State opposition leader who was their lawyer for the case.

A temporary injunction ensured their homes were saved initially. On 14 November 2006, the State Government claimed that the land belonged to them while the settlers maintained that land had already been given to a private developer. The court fixed April 30 th. to hear the case. Just three days after that on the 17 November and then on the 20 November, the local council (MPAJ) with the assistance of the police and developers came to demolish the homes. Many people were arrested and injured. The people rebuilt the houses and on 30 November, the houses and the surau(Place of worship) was demolished. The people have since rebuilt their homes until the latest attack on 5 th. March 2007.

Aftermath

After the last house was brutally torn down, some reports have indicated that this is the end of Kampung Berembang. The battle was lost today but the war remains to be fought and won. The people have merely retreated 50 meters outside the current settlement. They have put up their tents. With their original settlement fully closed, the struggle would now focus outside. While the ground was lost today, the spirit remains among some of the settlers who have pledged to carry on the struggle.

The last three days has seen intense struggle between the settlers and the developers. The police, the State and even the courts seem to be with the oppressors.   Malaysia with all its wealth cannot resolve the housing issues of its people. There seem to be no political will and the battle for housing rights is far from over – in Berembang, Rimba Jaya and else where.

Parti-parti berhaluan kiri merupakan parti politik pertama di Malaya dari PKM & KMM dari tahun 1930an sehingga kepada perjuangan PSM pada masa kini. Sempena dengan 50 tahun Kemerdekaan Malaya, Forum Sosialisma 2007 ingin meninjau sumbangkan parti kiri, peranan dan kritikan dalam tiga tahap iaitu zaman sebelum Kemerdekaan, zaman fron sosialis (60an – 70an)  dan zaman selepas kejatuhan tembok Berlin pada tahun 1989.

It’s time for BN and ISA to go!

ISA ARREST – TIME FOR BN TO GO !
We are not surprised with the arrest of Uthayakumar and 4 others M Manoharan, R Kenghadharan, V Ganabatirau and  T Vasanthakumaunder under the draconian Internal Security Act(ISA) . The BN media and its propaganda have been drumming the ISA beat for some time and we were sure that it was just a matter of time.
Badawi is no different than all the previous Prime Minister of Malaysia. They always resort to the ISA when they cannot handle a political storm and when they know the people are not with them. Today, the BN Government has done it again.
The iron rule of ISA has been the de-facto emergency in Malaysia since the 1948 emergency was lifted in 1960 and a day after that, the ISA was enacted. We are not interested to make long statement condemning the ISA as everything about the ISA and its draconian nature has been emphasized and said before.
It is time for the Barisan Nasional government to go. PSM will not be cowed by this continued cowardice rule of the BN. We would continue to build a movement with  people orientated groups, civil society movement and political parties to work for the defeat of BN. Only a defeat of BN can ensure a defeat of the ISA which has been ruling our lives for the last six decades.
Time for BN and ISA to go !

TWO KAMPUNG CHUPADAK SETTLERS ARRESTED

Sentul, 6 December 2007

At around  1.30pm, a team of police led by Inspector Mas Perwira and eleven other policemen without uniform encroached into Kampung Chupadak to arrest two leading leaders of the Kampung Chupadak struggle – Siti Soleha (Wan) and Rasidah. The police said that the developer Sri Murni have made against them. The settlers resisted the arrest and asked the police to furnish their ID card or a warrant of arrest during the standoff with the settlers. The settlers also questioned the double standards as they too have lodged report against the developer and asked if the develop was arrested.

The police then changed the script and said that they wanted to record their statement and the developer is also present at the police station. The two leaders refused to follow the police but then accompanied by other settlers went to the police station.

While recording the statement, further ruckus took place when the police refused to inform them about their rights while recording the statement and asked them irrelevant questioned. When the dissatisfied leaders were angry with the police and went to file a new police report, they were handcuffed. Further intervention by PSM’s Chairperson Dr. Nasir Hashim, the case was then taken over by another higher officer ASP Idris who then after listening to them, allowed the two leaders to leave.
Dr. Nasir later spoke of the vast violation which took place during the procedure like those arrested not being told of their rights while the investigation is not done by a neutral officer but by the arresting officer.

The settlers are also frustrated than during the entire period, the officer Mas Wira seems to be having constant discussion with the developer. The settlers are now quite convinced that the police are taking orders from the developer.

The Kampung Chipadak struggle has went on for 15 years. It has been quite for some time but it slowly starting to explode again.
